Welcome to Forget. These Terms of Service (the "Terms") are an agreement between you and Capable Koala LLC ("Forget", "we", "us"). They govern your use of the Forget website at forget.work, the Forget web app at app.forget.work, and the Forget app for iOS, together with everything we offer through them (the "Service").
By creating an account or using the Service, you confirm that you have read, understood and agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
You must be at least 13 years old to use Forget, or at least 16 if you are in the European Economic Area. If you are under the age of majority where you live, you may only use Forget with the involvement of a parent or guardian. By using the Service you confirm that you meet these requirements.
You need an account to use most of Forget. You agree to give accurate information when you sign up, to keep it up to date, and to keep your sign in details secure. You are responsible for what happens under your account. Tell us at [email protected] if you believe someone else has accessed it.
You can delete your account at any time from your settings on the web or in the iOS app. Deletion is permanent and cannot be undone. What it removes is described in our Privacy Policy.

Everything you create in Forget, including your tasks, descriptions, notes, labels and goals, belongs to you. We do not claim ownership of it.
To run the Service we need a limited permission to handle that content on your behalf, so you grant us a worldwide, non-exclusive, royalty-free licence to host, store, back up, transmit and display your content solely in order to operate, maintain and improve the Service for you. This licence ends when you delete the content or your account, except for copies held in routine backups until they expire. We do not use the content of your tasks to train artificial intelligence models.
You are responsible for your content, including having the right to store it and making sure it does not break these Terms.
Forget offers a free tier and a paid tier called Forget Pro. Forget Pro is available as a monthly subscription, a yearly subscription, or a one-time lifetime purchase. What is included in each tier is described in the app and on our website, and may change over time.
How you pay, and how you cancel, depends on where you bought Forget Pro.
Web payments are processed by Stripe. Subscriptions bought on the web renew automatically at the interval you chose, at the then-current price, until you cancel. You can cancel at any time through the billing portal in your account settings. Cancelling stops future renewals; your access continues until the end of the period you have already paid for.
Purchases made inside the iOS app are sold and processed by Apple through the App Store, and are also governed by Apple's terms.
Prices are shown before you buy and may vary by country. We may change prices for future billing periods, and where the law requires it we will give you notice and the chance to cancel before a change takes effect.
Except where the law requires otherwise, payments are non-refundable and there are no refunds or credits for partly used periods. Refunds for purchases made through the App Store are handled by Apple, not by us; request them through Apple. For purchases made on the web, contact us at [email protected] and we will deal with your request in line with the law that applies to you. If you are a consumer in the EEA or the UK, your statutory cancellation and refund rights are unaffected by anything in these Terms.
The following applies to the Forget app downloaded from the Apple App Store, and Apple requires us to state it.

Our Privacy Policy explains what information we collect, how we use it, and who we share it with. By using the Service you agree to that policy.
We may change, suspend or discontinue any part of the Service. If we discontinue the Service, or make a change that materially reduces what a paid plan provides, we will give you reasonable notice where we can and, where the law requires it, a pro-rated refund for any period you have paid for and cannot use.
You may stop using Forget and delete your account at any time. We may suspend or terminate your access if you break these Terms, if we are required to by law, or if your use puts the Service or other users at risk. Unless the law or the seriousness of the breach makes it impractical, we will tell you why. If we terminate your account without cause while you have paid for a period you cannot use, we will refund that unused portion.
When your account ends, your right to use the Service ends with it. The sections on your content, disclaimers, limitation of liability and governing law survive termination.
The Service is provided "as is" and "as available". To the maximum extent permitted by law we disclaim all warranties of any kind, whether express or implied, including the implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Service will be uninterrupted, error free, or that any data will always be available or preserved.
Forget is a productivity tool. It is not a medical device and it does not provide medical, psychological or professional advice, including for ADHD or any other condition.
Keep your own copies of anything you cannot afford to lose. While we take backups, you are responsible for your own records.
To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data or goodwill, arising out of or related to your use of the Service.
To the maximum extent permitted by law, our total liability for all claims relating to the Service is limited to the greater of the amount you paid us in the twelve months before the event giving rise to the claim, or fifty United States dollars.
Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages. Where that is the case, the exclusions and limitations above apply only to the extent permitted, and nothing in these Terms limits liability that cannot be limited by law.
These Terms are governed by the laws of the State of [STATE TO BE CONFIRMED], United States, without regard to its conflict of law rules. You and we agree to the exclusive jurisdiction of the state and federal courts located there, except that either of us may seek injunctive relief in any court of competent jurisdiction.
If you are a consumer, nothing in this section deprives you of the protection of the mandatory laws of the country where you live, or of your right to bring proceedings in the courts of that country.

We may update these Terms as Forget changes. When we do, we will update the effective date at the top of this page, and if the change is significant we will tell you by email or in the app before it takes effect. Continuing to use the Service after a change takes effect means you accept the updated Terms. If you do not accept them, stop using the Service and delete your account.
